SAMUEL ORTIZ-GARCIA AND AGUSTIN RODRIGUEZ-ADORNO CHARGED WITH CARJACKING AND MURDER. DEFENDANT SAMUEL ORTIZ-GARCIA REMAINS FUGITIVE, ANOTHER INDIVIDUAL REMAINS UNIDENTIFIED San Juan, Puerto Rico-Rosa Emilia Rodríguez-Vélez, United States Attorney for the District of Puerto Rico and Luis S. Fraticelli, Special Agent in Charge (SAC), Federal Bureau of Investigation (FBI) in Puerto Rico announced that a four- count indictment was issued on June 19, 2007, in the District of Puerto Rico (P.R.), charging Samuel Ortiz-Garcia, aka “Sammy”, aka “El Primo”, and Agustin Rodriguez-Adorno, aka “Puntigo”, aka “Junito”, with a carjacking offense, that is, taking a motor vehicle that has been transported, shipped, or received in interstate or foreign commerce from the person or presence of another by force and violence or by intimidation in violation of Title 18, United States Code, Sections 2, 371, 924 (c) (j) and 2119 (3). The defendants have also been charged with use and discharge of a firearm in furtherance of the carjacking offense and causing the death of a person through the use of a firearm. On May 12, 2007, at the “Subway” fast food restaurant in Piñeiro Avenue, Rio Piedras, Puerto Rico, Agustin Rodriguez-Adorno, Samuel Ortiz-Garcia and a third assailant, aiding and abetting each other, during the early morning hours did attempt to take a vehicle driven by the victim, Gilberto Santiago-Quiñones. The defendants demanded the occupants of the car open the door and indicated that this was the car they were going to take. Defendant Samuel Ortiz-Garcia fired multiple shots into the car of victim Gilberto Santiago-Quiñones, after the third assailant (unidentified as of yet), said “he’s tough, shoot him”. Said actions resulted in the death of Santiago-Quiñones. On June 12, 2007, Agustin Rodriguez-Adorno was placed in federal custody after the United States Attorney’s Office assumed jurisdiction over the case. Samuel Ortiz-Garcia aka “Sammy”, aka “El Primo” remains a fugitive. The FBI is actively attempting to locate the unidentified assailant, and Samuel Ortiz-Garcia, age 31. Ortiz-Garcia is currently considered to be a fugitive from justice. The public is cautioned that he should be treated as Armed and Dangerous. The FBI is offering a reward for information leading directly to the arrest of Samuel Ortiz-Garcia. Attached is a photograph and information of Ortiz-Garcia. The third individual unidentified is possibly known as “Miguel el Ciego” and/ or “Busca Aviones”. The public is reminded that an indictment contains only charges and is not evidence of guilt. The defendant is presumed innocent and is entitled to a fair trial and the government has the burden of proving guilt beyond a reasonable doubt. This case is being investigated by the FBI and prosecuted by Assistant United States Attorney Julie Mosley.
